The County of Santa Clara is the Lead Agency which has prepared a Recirculated Draft Environmental Impact Report (DEIR) pursuant to the California Environmental Quality Act (CEQA) to evaluate the potential environmental impacts for the Z-Best Compost Facility Modifications Project. Public comment period was April 20, 2023 to June 20, 2023.

Application status update (April 29, 2022)

In July 2021, the Applicant filed a lawsuit challenging the Department’s April 7, 2021, incompleteness determination under the Permit Streamlining Act (Gov. Code § 65920 et seq.). The parties agreed to settle the lawsuit and asked the Court to enter the Stipulated Judgment.

Pursuant to the Stipulated Judgment:

  • The Application was deemed complete as a matter of law on April 1, 2021.  The County’s April 7, 2021, Notice of Incomplete Application Letter had no legal effect on the status of the Application.
  • The Application is subject to the grandfathering clauses set forth in Section 8 of Ordinance No. NS-1200.378 and Section 2 of Resolution No. BOS-2021-63, adopted by the Board of Supervisors on May 25, 2021 (collectively, the “Amendments”).  
  • Accordingly, the Application shall be processed by the Department in accordance with all provisions of the County General Plan and Ordinance Code, including Appendix I (Zoning), applicable to Recreational Vehicle Parks that were in effect immediately preceding the effective date of the Amendments.
  • The court retains jurisdiction to enforce the Stipulated Judgment.
